Chinese game company X.D. Global is distributing the PC version of 'Langrisser'. X.D. Global says that the PC version of 'Langrisser' is a test version, but it has not been confirmed as a ‘game products for testing’ by the Game Rating and Administration Committee. X.D. Global also did not comply with Article 21-3 of the GAME INDUSTRY PROMOTION ACT
The mobile game 'Langrisser' was released in South Korea in June. And X.D. Global recently began distributing the PC version of 'Langrisser' through the official website of ‘Langrisser’. Anyone can download the PC client and enjoy the PC version of ‘Langrisser’.
The PC version of 'Langrisser' has not been rated in South Korea. In general, in accordance with Article 21 of the GAME INDUSTRY PROMOTION ACT, a game needs to be rated before being distributed in South Korea. Games are rated by Game Rating and Administration Committee or the company that is designated as ‘independent rating classification business entities’.
However, the gaming committee discussed the PC version of 'Langrisser' internally, and judged that the PC version of 'Langrisser' does not need to be rated separately. The rationale behind this decision is the 'self-rating' clauses in the GAME INDUSTRY PROMOTION ACT. Simply put, the PC version does not need to be rated separately, because the content of the PC version is exactly the same as the previously released mobile version.
But even in this case, there are regulations that must be followed. It is the ‘obligation to notify’ prescribed by Article 21-3 of the Game Act. The game company should notify the Game Rating and Administration Committee the fact that the game that is rated by independent rating classification business entities is being distributed through the other company. But X.D. Global did not notice Game Rating and Administration Committee that. A person who violates the 'obligation to notify' shall be charged a fine of up to 10 million KRW under Article 44 of the GAME INDUSTRY PROMOTION ACT.
And there is another problem. Like the PC version of ‘Langrisser’, if the game company conducts the test, it must be confirmed by ‘Game Rating and Administration Committee’. Article 21 of GAME INDUSTRY PROMOTION ACT stipulates exceptions that do not need to be rated. Exceptions include ‘game products for testing’. However, in order to be recognized as ‘game products for testing’, various requirements prescribed by the ENFORCEMENT DECREE OF THE GAME INDUSTRY PROMOTION ACT must be satisfied, and a ‘certificate of game products for testing’ must be issued from ‘Game Rating and Administration Committee’.
However, the 'X.D. Global did not receive a ‘certificate of game products for testing’ for the PC version of ‘Langrisser’. Therefore, the PC version of ‘Langrisser’ is not a ‘game products for testing’ prescribed by GAME INDUSTRY PROMOTION ACT.
